‘The View’s Sunny Hostin Accuses Trump Of Using The Presidency To “Avoid Going To Jail”

    Published on

Sunny Hostin just said the quiet part loud: Donald Trump ran for president to avoid prison.

On The View this week, the host laid out what many have long suspected—that Trump’s 2024 campaign wasn’t about making America great again, but about making sure Donald Trump doesn’t end up in a jail cell.

“I really do believe that the reason President Trump ran for the office of presidency again is because he wanted to avoid going to jail,” Hostin told her co-hosts.

WHAT’S GOING ON: The conversation kicked off as the hosts discussed former special counsel Jack Smith’s recent testimony before the House Judiciary Committee. Smith dropped a bombshell, claiming he found “proof beyond a reasonable doubt that President Trump engaged in criminal activity” during his investigation into Trump’s handling of classified documents at Mar-a-Lago and his alleged interference in the 2020 election.

Joy Behar asked the obvious question: “If he’s saying that he has the goods on the guy and that he broke the law… why isn’t Trump in jail?”

Co-host Alyssa Farah Griffin gave the blunt answer: “Because he won the election and 75 million people still voted for him, despite these facts.”

THE DETAILS: Hostin explained that longstanding Department of Justice policy prevents a sitting president from being indicted or prosecuted. Smith was forced to drop both cases against Trump when he won the 2024 election—not because the evidence disappeared, but because the DOJ’s own rules shield whoever occupies the Oval Office from criminal accountability.

Sara Haines piled on, noting that Trump “hasn’t been held accountable” and has been saying “since he came down the escalator that he can shoot someone and get away with it.”

She’s not wrong. Trump literally bragged about this during his first campaign, and here we are.

OF COURSE: This isn’t Hostin’s first rodeo calling out Trump’s behavior this week. She previously ripped him as “deeply unserious and so deeply unpresidential” after he called himself “Daddy” during his address at the World Economic Forum in Davos. “It’s sad and an embarrassment to our country,” she said. “I’m so disgusted by this.”

She also labeled him an “imperialist president” over his continued threats to seize Greenland. “Every single country is at risk,” Hostin warned. “This is an imperialist president. He wants to colonize everybody, every country.”

WHY IT MATTERS: The DOJ policy that Hostin referenced isn’t a law—it’s a memo from 1973, updated in 2000, that essentially grants the president immunity from prosecution while in office. Trump has now weaponized this loophole twice. First, he used it to dodge consequences for obstruction of justice during the Mueller investigation. Now, he’s using it to escape charges for hoarding classified documents and allegedly trying to overturn a democratic election.

The system isn’t broken. It’s working exactly as designed—to protect the powerful from accountability. And Trump figured out that the ultimate get-out-of-jail-free card isn’t a pardon. It’s the presidency itself.
