What the law says about Trump’s D.C. takeover

Trump seized direct control of D.C.’s police Monday—the first time any president has done so—and deployed the National Guard, despite local data showing crime is at historic lows.

The big question, though: Is it legal?

SOME BACKGROUND: Washington, D.C., has had partial self-governance only since 1973, when Congress passed the Home Rule Act.

  • Under Section 740 of that law, the president can assume control of the city’s Metropolitan Police Department for up to 48 hours during an “emergency,” with possible extensions to 30 days.

However, no president, Democrat or Republican, has used that authority—until Trump.

THE FUTURE: The police takeover expires after 48 hours unless extended, and cannot exceed 30 days without Congress.

  • To strip D.C. of its Home Rule entirely, Congress would have to repeal the 1973 law — something Republicans have floated but would face steep Democratic opposition.

BIG PICTURE: Civil liberties groups say this is a dangerous precedent — giving the federal government power to override local democracy whenever it chooses.

  • The ACLU warns it could be a blueprint for crushing progressive-led cities under the guise of “law and order.”

  • This move comes as Trump is already facing legal challenges over deploying the National Guard in Los Angeles against the wishes of California’s governor — another Democratic-led jurisdiction.

Courts have so far allowed that deployment to continue.

WHAT’S NEXT: The D.C. takeover is almost certain to be challenged in court.

  • But even if struck down, Trump’s gambit signals a broader authoritarian push—using rare executive powers to dismantle local control in places that vote against him.

This isn’t just about D.C. It’s about whether any American city run by progressives is safe from Trump’s power grabs.
